In 2007 then president Bush signed in law the “Mortgage Forgiveness Debt Relief Act” This act protects you from paying taxes to the IRS on Phantom Income. What is Phantom income? It is the income you never see but is passed on to you by your lender in the form of a 1099. This form is sent to you by your lender after the sale of your home. the 1099 will have a dollar amount on it in the amount that the lenders loss on your sale.Before this act was passed into law the IRS could tax you on this Phantom income.The Mortgage Forgiveness Act is due to expire Dec 2012.
